Because once they've been charged, the charge cannot be escalated whatever evidence is gained afterwards.
So, they may be holding out till they have enough evidence to charge them with murder, rather than just charging them at the moment with the PT equivalent of manslaughter.

Yes, vilipend, I have ideas. It is unfortunate that you missed the posts about this subject in another thread a few weeks before Christmas. One was from an ex-pat living in Portugal, the other was from Pear. Together they provided an excellent summation of the workings of the Portuguese system.
On the Continent, judicial procedure tends to be derived from the Code of Napoleon rather than English common law. The process is therefore considerably different: In Portugal, with few exceptions, trials are conducted before a panel of judges instead of a jury. The public prosecutor (in this case, Jose Magalhaes e Meneses) participates more actively in the investigation than prosecutors do in the UK. Being named a suspect has legal consequences that it does not have in the UK. I do not know what Portuguese law says on this subject, but in France a person can be arrested and held in custody for as long as FOUR YEARS before formal charges are filed; in Italy, the length of time is a year.
In Portugal, there are limitations on what can be done investigatively after a suspect is arrested. If a suspect is caught red-handed, so to speak, standing over a bleeding body with a smoking gun in hand, he can be taken into custody immediately in the interests of public safety while the investigation proceeds. It is much more common, however, for suspects to be arrested and charged only at the end of a thorough investigation. I cannot tell you for sure if this is codified, or if it is the result of an administrative requirement that they cannot "charge up." Once charges are filed in Portugal, if additional investigation should bring more serious crimes to light, they cannot merely file superceding paperwork. The police are required to start from ground zero administratively, opening a new file and creating a separate paper trail documenting the additional charge. Understandably, they are reluctant to go through all this unless there is some pressing reason and therefore do not file charges the first time they get a piece of evidence in hand that indicates a crime has occurred.
Personally, I think this is a good system. There are never enough investigators to go around, and in the past I was occasionally pressured by a supervisor to write up a summation of the evidence I had and ask the prosecutor to proceed with charges when I felt that additional investigation would have produced a stronger case.
