Lower Third – Ocean Club Employee was pressured by Kate McCann to tell what she knows

Voice Over: What she saw, what she knows, and what could have this employee of the Ocean Club said to raise such an interest by the McCanns? 'Francisca', a fictitious name, was persistently approached at the end of the last year by the ‘spearhead’ of the couple in Portugal. Susan Hubbard, the wife of the Anglican Father [Haynes], in Praia da Luz, went various times to the tourist complex, to the house and even left notes in the mail box. She was determined to put her [the employee] in contact with Kate.

‘Francisca’ – She told me: ‘Kate wants to make contact with you, because she wants to make you questions, etc...’. And I said: ‘What questions? Because there’s a detail, at the time I was on my break. I had three days off, do you understand it?’ So, what I have seen, what I have not seen, who was there, who was not, I don’t know.

Voice Over: This witness might be key in the investigation, since she lives near to the church – the place where the former coordinator of the investigation suspects that Madeleine’s body passed through. The worker for the position she occupied, controlled a great part of the conversations and faces that appeared in Praia da Luz during the long months of the investigation. The insistency of Susan, so that ‘Francisca’ gave her personal email address arouse suspicions.

‘Francisca’ – She wanted to get in my ‘site’, to see who I was talking to or who I was in contact.

Voice Over: The contact with Kate happened a month later, via SMS. In the texted messages, Madeleine’s mother, warned that family members would go to Praia da Luz in the following days, and that she would be contacted personally. The approach was made, not by the mother nor by Gerry’s sister, but by Arthur Bailey [fictional name?], a detective hired by the family, who was once an inspector of the Scotland Yard.

‘Francisca’ – He made me some questions, what were my impressions, lots of things…

Journalist – And do you believe that they were suspecting that you…

‘Francisca’ – That I knew more than what I was saying.. That was my impression…

Journalist – …That you were working as an informer to someone?

‘Francisca’ – Exactly.

Voice Over: From the talks that she had with her colleagues ‘Francisca’ believes that she was the only Ocean Club employee target of the private detectives and of the couple. She doesn’t have doubts that Madeleine is dead and she hopes to explain why to Gonçalo Amaral, now that the former inspector is committed in reopening the process.

Dear CHARLOTTE and NAJOUA,
Although we do not know each other, I feel I know a little about you and your kindness.
How dreadful it must have been for you both to have witnessed such a tragedy. MADELEINE just three years old abducted from her bed. Both of you saw how devastated the McCANNS were. The shock and horror on their faces.
NAJOUA, you mention you only saw MADELEINE to wave hello and you CHARLOTTE were a nanny at the Creche. It must have been hard to find the right words to say to KATE. She also was finding it hard to say the right words to you, or anybody else.
What can you say to a mother in torment as you struggle to understand?
It is now almost three years, we are ALL older and wiser. OLDER, certainly.

CHARLOTTE I have read your witness statement. I have also read an interview you gave to the Daily Mail. I have to admit I am confused by a comment you gave. In the Mail you mention something that you did not mention in your statement.
CHARLOTTE you said you were one of the first in the apartment and the twins WERE NOT THERE.
You said they had already been taken out by one of the McCANN’s friends…
CHARLOTTE, much time has passed. Surely you NOW understand the significance of these words now, if they are true, don’t you?
I do realise the Daily Mail not known for its, shall we say ‘Honest’ reporting and they may well have twisted your words. But that is what they printed you having said:
“We knew that one of the other nanny’s charges was called Maddie. We told the head of department what had happened and she took us straight to the apartment.
There were no children in the room. The twins had been taken out already, I think by one of the McCanns’ friends.
When we were coming out we saw Kate and she was screaming: ‘They’ve taken her. They’ve taken her!”

But it’s not about what was printed or not, but about what you might know.

NAJOUA, you are a stunning young woman with a figure any woman would envy, any man not forget and yet no one seems to remember you on the night Tuesday 1st May 2007.
I have also read your statement to PJ and believe you when you say you were invited by GERRY McCANN to sit at his table.
NAJOUA, it matters not to me, how many people and who was or was not at the table that night. But, it does matter very much WHERE “that” table was, whether you were invited to it or not…
The McCANNS had just lost a child to an evil man, you wanted, like all to help. Not cause the McCANNS any more pain. MADELEINE was kidnapped on Thursday, so what was the difference of where they actually had dinner on Tuesday? A detail with little or no importance to the effort of capturing the person that had taken MADELEINE.
Everyone wanted to help the McCANNS and do and SAY the right thing to ease their pain. They had lost a child and if they asked for certain things not to be mentioned because THAT would cause more problems. Unnecessary ones, so who would NOT agree to do all they can? MADELEINE was missing and that’s all that mattered, she must be found.
NAJOUA, by now you know that the couple you so kindly helped, phoned family and friends to tell them of a smashed and jemmied window. This, you now also now, was NOT TRUE, there was NO evidence of a break in.
I’m sure, that by now, you have asked yourself many times why would they lie?
And, I’m sure that you’ve asked yourself why they asked you to say to the Police that you were with them Tuesday night.
I now ask you both, CHARLOTTE and NAJOUA, to think and search your hearts for what is right. MADELEINE, what would have been her seventh birthday approaches. Seven candles on a cake waiting for the Birthday Girl to blow them out. The birthday girl that should be laughing and playing in the warm sunshine. A little girl tired after an exciting day, brushes her teeth and is ready for bed. She may well even say ‘Mummy I have had the best day ever’


I ask you both as the warm and loving young ladies I know you to be, if there is something that now makes you uncomfortable with. Something you felt pressured, or convinced, to say, something that was not quite true.
No one wants to see any of you accused of anything, what we ask is for the case to be re opened and the PJ allowed to do their job.
 


I ask you both to only think of MADELEINE. She was ONLY three years old. LOOK into her eyes and if you feel uncomfortable with something you have said, no matter how small I beg you to speak out.
You had nothing to do with MADELEINE having disappeared, and yet you carry a burden. It’s time, I beg, to take that weight off your shoulders.
Details are so very important. A small detail twisted may have harmed the investigation and the search for MADELEINE.
Maybe one, or both, of you can help and UNTURN some of those stones GERRY McCANN talks so often about.
I know the authorities seem a little too permeable, and that that such an effort would not only be useless as would also seem bring back needless problems and haunting memories.

"Leave us alone once and for all", is the request made by a former Ocean Club employee, in praia da Luz, Lagos, who has been "insistently" contacted by a new group of private investigators hired by the McCann couple.

"They've contacted me three times, by letter, by phone and recently they cam knocking at my door. They were two women, one Portuguese another English, searching for evidence to reopen the process, but we want to forget what has happened. We will only answer to questions made by the Judiciary Police", vented the woman in frustration. She is one of the witnesses heard during the investigation to Madeleine's disappearance, in May 2007.

This is an action that the former coordinator of the Portuguese Judiciary Police classifies as "illegal". Even suggesting for "those people to be identified and heard by the police because they are committing a crime."

This revelation comes a day after Wikileaks, quoted by Spanish newspaper "El País", disclosure of the contents of a conversation between the United Kingdom and the United States ambassadors, with the first affirming that the police of his own country had gathered evidence incriminating the child's parents.

"That had been already stated by the PJ and figures on the process. It was the conviction of both police forces, however it had never been assumed from the British side. The only novelty is, that, for the first time, there is someone who is not Portuguese, affirming that there were suspicions against the couple, which reinforces the investigation thesis", said Gonçalo Amaral.

For the family spokesman, Clarence Mitchell, it is "a historical note with more than three years old. Kate and Gerry have seen their status as official suspects lifted, with the Portuguese authorities assuming that there was no evidence that implied them in Madeleine's disappearance."

To JN, a source of the Portuguese Public Relations team hired by the McCann couple [Salvador da Cunha's Lift Consulting], confirmed that there is a "private investigation team" lead by a former UK cop, Dave Edgar, trying to gather proofs to reopen the process, archived back in July 2008.

Yesterday, in a declaration, the Portuguese Attorney General, considered that there are no "new, credible and relevant" facts to determine the reopening of the investigation related to Madeleine McCann.

An employee of the Ocean Club, the place where Madeleine McCann was seen for the last time, claims to have been the target of pressure from the girl’s mother, Kate McCann.
The employee of the Praia da Luz resort, when interviewed by SIC Noticias, reveals that she was bombarded with SMS and “written messages” asking her to tell all of what she knew about the persons who entered and left the resort.
She adds that she was also approached by a private detective contracted by the McCanns, Arthur Bailey, a former Scotland Yard officer.

It was Francisco Pagarete, Mr Murat’s Portuguese lawyer - the one whom he was so anxious to see when he flew out to Praia da Luz on 1 May - who confirmed that a second meeting involving Brian Kennedy took place at Mr Murat’s uncle’s house in the Algarve in November. He told the BBC: “[Brian Kennedy] came here to give his support to Robert and to say he doesn’t believe Robert was involved in this story in any way or sense. And he asked if Robert could help the investigation for the finding of Madeleine in any way”. Mr Pagarete added that MrKennedy had ‘promised to stay in touch with Mr Murat’ but ‘had not contacted him since’. Mr Pagarete also confirmed that Edward Smethurst was at the meeting. 

The Portuguese paper Jornal de Notícias appeared to have some additional information about this meeting. Their report, early in 2008, said: “The meeting - a dinner that Brian Kennedy asked to be discreet and far away from the eyes of the press - took place in the end of last year at a house of Murat's relatives in Burgau (Vila do Bispo). At the dinner were Robert Murat and Kennedy, their respective lawyers, Jennifer Murat and the aunt and uncle of Murat” [NOTE: This appears in fact to have been Ralph Eveleigh, Murat’s uncle, and Sally Eveleigh, his cousin]. 

If Murat and Kennedy each had one lawyer with them - Pagarete and Smethurst - that makes seven people present at that dinner in Burgau: Murat and his mother, his uncle Ralph and cousin Sally Eveleigh, who ran the 8-room guest house at Vila do Bispo, two lawyers and Brian Kennedy. 

What was discussed at this meeting that Kennedy didn’t want the press to know about?

This evening meeting was either on the same day, or very close to, the meeting that Brian Kennedy had with the Portuguese Police on 13 November 2007 that we referred to above. The two Portuguese Police Inspectors, Ferreira and Paiva, later submitted an account of their strange meeting with Brian Kennedy.

For the family spokesman, Clarence Mitchell, it is "a historical note with more than three years old. Kate and Gerry have seen their status as official suspects lifted, with the Portuguese authorities assuming that there was no evidence that implied them in Madeleine's disappearance." At the dinner were Robert Murat and Kennedy, their respective lawyers, Jennifer Murat and the aunt and uncle of Murat” [NOTE: This appears in fact to have been Ralph Eveleigh, Murat’s uncle, and Sally Eveleigh, his cousin].
