Madeleine\'s parents consider new fund for legal battle

The family source said: “I don’t know [what they are going to do]; that is one of the routes they can go down. Money is going to be a big problem I think. PR firms and law firms are not cheap and it is clear the fund will not be for legal advice but that is the least of their worries now.\"

On Friday a family friend, David Hughes, said that the fund was looking into whether it could by law pay for the couple’s defence but today he confirmed that Mr and Mrs McCann would not apply for money from the fund.

Outside the family home in the village of Rothley in Leicestershire, he said: “Gerry and Kate’s view is that if they take money from the fund, it might be that 90 per cent of people who made donations aren’t bothered about it. But if 10 per cent of people are bothered about it, they don’t want to upset them. They want to take the controversy out of the situation.”

Donations totalling £1,036,104.17 have so far been received for Madeleine’s Fund: Leaving No Stone Unturned, according to the official campaign website. The fund, which for legal reasons is not a charity, has four objectives, one of which is “to provide support, including financial assistance, to Madeleine’s family”.

The McCanns appointed lawyers in Portugal and Britain after being named as formal suspects - but they will not be paid out of money donated by well-wishers.

A statement made by Esther McVey from the board of Madeleine\'s Fund said payment of legal defence costs would be legally permissible so long as they were repaid in the event of a guilty conviction.

However, she said the fund\'s directors recognised the spirit in which the generous donations were given and decided not to pay for the McCanns\' legal costs.

\"We stress that Gerry and Kate have not asked for these costs to be paid,\" she said.

So far donations totalling £1,036,104.17 have been received for Madeleine\'s Fund: Leaving No Stone Unturned, according to the official campaign website.

Tycoons Refuse To Give Madeleine Parents Cash For Legal Bill

Millionaires who bankrolled the campaign to find Madeleine McCann are refusing to fund her parents’ legal defence, the Evening Standard revealed.

Two wealthy individuals who helped Kate and Gerry McCann in their global search for Madeleine now say they will not pledge any more cash at this time.

When contacted by the Standard they refused to be named because of the sensitivity of the issue. But one leading tycoon said that without knowing the facts about the Madeleine case, it would not be possible to pay for their legal team.

The couple have been named formal suspects in the police investigation and may be charged at any time.

The McCanns have hired Britain’s top criminal law specialists Kingsley Napley to clear their reputations. But with the investigation dragging on, their legal costs could run into millions if the case goes to trial.

As revealed in the Standard, the trustees of Madeleine’s Fund - which has raised more than £1mn – on Wednesday announced they would not allow the McCanns to use the money to pay their lawyers. The couple had said earlier they did not want the money anyway.

One businessman told the Standard: ‘I am not going to contribute any more. It is a difficult issue and it is not something I propose to get engaged in. It is the most confusing scenario anybody has ever seen. I am not judge and jury and I hope what I am reading is wrong. If they cannot convince the people who already put the money in, they are not starting in a good place. If they can turn the tide in some form maybe there will be loads of backers. But right now this does not look a good place to go.’

Another tycoon who pledged more than £100,000 to the Find Madeleine appeal ruled out making a donation to the legal fighting fund.

‘We won’t be pledging any more right now,’ said the entrepreneur, adding: ‘I don’t think that at the moment we would allow the money to be swapped to cover defence costs, but this is a difficult position and a very sensitive issue.’<!-- google_ad_section_end -->
