Witness statement

Barrington Godfrey Norton

Residence: Uncertain location in P da L, in a Ford vehicle, model Escort Van, licence plate nº S677 YWP

Profession: Music teacher

He comes to the process as a witness, as a result of his very frequent presence in the immediate vicinity to the place Madeleine disappeared from had been referred to, since the date of her disappearance.

When asked, he says that he does not speak Portuguese and is assisted by the interpreter, Natália de Almeida.


The witness says that he arrived in this part of Portugal about 5 years ago, adding that since then he had gone to live in the immediate vicinity of P da L.

He has always worked in professions associated with music and he is currently dedicated to teaching as well as performing in the streets of P da L.

Since the beginning of April 2007, he has been living inside his vehicle, a white Ford Escort van, licence plate nº S677 YWP, as he is currently looking for a place to establish his residence as well as a music school.

When confronted with the fact that his presence has been frequently noticed during the past days in the immediate vicinity of the OC, the witness admits that since the disappearance of Madeleine which was reported on the night of 3rd May, he had often gone to the place in order to find out from the British journalists whether there was any news about the girl’s whereabouts.

When asked, he said that the reason for his special preoccupation with this fact was because of the circumstance of the victim being a British girl and the fact that she was “of a very tender age”.

When asked to reconstruct his movements between 1st and 4th May of this year, the witness mentions that he cannot be precise, but as a general rule, he had the following daily routine:

09.00 – 10.30 Guitar practice on the beach.

11.30 Lunch in the Jardim Restaurant, situated in Rua Direita, in P da L, where he would remain until 12.15 – 12.30.

The he would go to a friend’s house, in order to get his guitar amplifier, before going to Avenida dos Pescadores, where he would play his guitar until 15.00 – 15.30.

As a general rule, he would then go for music classes, if he did not have any, he would go to P da L.

At about 20.00 he would have dinner in the Penini Restaurant or another international restaurant nearby, both in P da L, or go to the Baptista supermarket in the OC.

Then he would eat his food in a P da L parking area.

At 21.00 – 21.30 he would go to a camping site in his vehicle and spend the night there.

When asked to provide more precise detail about 3 rd May, the day on which Madeleine disappeared, he clarifies that the day was absolutely similar to the others, he has difficulty in providing more detail.

When asked if he had music classes that day, he replied that he did, from 16.45 to 17.45 with the son of ***** ***** resident in **** ****, Vila da Luz, and that the lesson took place at her house. From 18.15 – 19.15 he gave a lesson to his dentist’s son.

When asked to try to remember where he had gone after the music classes, he says that at about 19.15 he went to drink a beer at the Jardim restaurant and after this, at about 20.00 he went to fetch his dinner from a place he cannot remember, being certain that he had his meal at the usual place (parking area near to the beach).

At about 21.00 he went to sleep in the usual place.

When asked whether he had been seen by anyone whilst he was eating or when he went to the place where he slept, he replied that it might well be possible but that he frankly does not remember.

When asked how he found out about the disappearance, he mentioned that at about 01.00 of 4th May when he was asleep at the usual place (camping site near the beach), he noticed flashing blue lights, immediately presuming that they came from a police car. At about 01.30 he was approached by OC staff, telling him that at about 22.00 the girl in question had disappeared from the resort.

He remembers that at about 07.30 on 4th May he was approached at the same site by GNR officers who carried out a search of his vehicle, but did not find anything unusual.

When asked whether he knew Madeleine or her parents, he replied that he did not.

When asked if he would regularly to the OC resort, he replied that he did, adding that he often went to the Baptista supermarket in the resort.

He mentioned that, during the previous week, he cannot remember the exact days or times, he went to the resort another three times, for different reasons than those mentioned previously, once to hand in his CV and the other two times, to be with friends who were on holiday there.

When asked to provide more details about the individuals in question, he said they were a Canadian couple, the man was called L*** V****** and his wife was called S******.

When asked if he knows on which date the couple arrived, he says he does not, presuming that they had been on holiday at the resort for about 15 days, knowing that they had already returned to their country.

When asked if his friends worked he said that he only knows they were retired.

When asked if he had gone to the OC to see them, he said that he had gone once, not being able to state exactly the location of their room.

When asked about his displacements to the resort and whether these always took place using his vehicle, he replied affirmatively.

When asked where he would park, he said he would generally park near the Baptista supermarket.
When asked if he had ever parked in the street next to the apartment Madeleine had disappeared from, he replied that he had once, as far as he remembers, after her disappearance, that apartment being near to the Baptista supermarket.

When asked whether his hair is always cut short as it is now, he replies no, adding that he used to have much longer hair, especially longer in the neck, but that it had been cut about a month ago and that on the current day he had just had a small hair cut to tidy up the points.

When asked where his hair cuts took place, he replied at a friends house, whom he knew as T**** in Rua Direita.

When asked again whether on 3rd May between 20.00 and 22.00 he had been at the OC resort, he replied negatively.

When asked if he remembers having gone at the beginning/middle of the afternoon to the resort on 2nd and 3rd May, he replies that he does not remember, thinking it possible that he could have gone to the Baptista supermarket, remaining there for while, because he often buys food there and consumes it in the streets of the resort.

When asked if he ever went to the Tapas Bar at the OC resort, he replies negatively.

When asked if he can provide any elements leading to the whereabouts of Madeleine or the identification of the person responsible, he replies no, guaranteeing that he would contact the police immediately if he knew anything pertinent.

Witness Statement

He comes to the case as a witness following the events on the morning or early afternoon of 2nd or 3rd May (last Wednesday or Thursday) which might have a bearing on the present investigation.
As he does not write or speak Portuguese he is assisted by an interpreter, G.L.C. de Jesus, at the request of the PJ.
Relating to the events of the present investigation he states that he owns a holiday home on Rua do Ramalhete in Praia da Luz where he spends extended holiday periods in our country together with his long-time partner of 36 years, C.M.D***.
They both arrived in our country on the early morning of 29 April 2007 having stayed at the above residence.
Subsequently, during the late morning or early afternoon of either 2nd or 3rd May, not being certain which, the witness and his partner were out walking in the vicinity of their home.
When asked, he does not recall the exact route taken but they went up from their home to Rua Dr. Agostinho da Silva then down Rua Dr. Francisco Gentil Martins where the "Ocean Club Gardens" is situated.
At that time as they passed the residential block he noticed a light commercial vehicle, (in all respects similar to an Opel Corsa Van), white in colour but dirty, with only one side window in the sliding panel door, but he does not know the exact make, model or other identifying characteristics - including the number plate.
All things considered he judged it to be an old model.
When going down the [Rua Martins] he passed an individual standing on his left at the beginning of a path and at the entrance of a small car park opposite the reception of the resort.
At the point they passed the individual the witness saw him face-on because he [the man] was facing the opposite direction to which he [the witness] was walking, and appearing to be watching attentively movements [occurring] adjacent to the parked vehicle.
When asked, the witness said that he noticed the above because he had a high instinct for vigilance [observation, watchfulness] due to his participation where he lived in England in a neighbourhood-watch in which suspicious persons or movements were watched for and detected to maintain order, unlike his partner who detected nothing of such incidents.
Hence, he was aware that the man's attention was fixed on the area in question [adjacent to the van] in such a way that he [the man] was unaware of the witness’s presence.
Urged to describe the man, the witness said he was Caucasian, dark-skinned, medium stature, 1,70 to 1,75m tall, about 25 to 35 years old.
He added that the man had dark and thick hair but with no noticeable fringe [at the front].
Regarding [the man's] clothing he adds that he didn't observe this in detail, judging that [the man] wore a plain T-shirt, possibly yellow.
The witness wished to clarify that he was convinced that the man was not one of the many tourists who frequented that area, considering his features and physical appearance.
When asked, the witness said that, initially, he had associated the man with the van because [the man] had looked deliberately at the area around it.
Notwithstanding [the above], having learned of the disappearance of MBM on 3 May from inside one of the resort residences mentioned above, he linked the two and that was the reason he came forward to the police.
When asked to elaborate further he said that the van was situated close to the gateway on the side of the building which led to the veranda of the apartment in question [apartment 5A].
Hence, one could conclude that the man was monitoring the movements next to that gate and, possibly, of the interior of the apartment.
For the rest, he adds that after having reflected specifically on the incidents he concluded that it was the man's deliberate focus on the area in which the events that gave rise to the investigation occurred.
Urged to reveal details about the area around the van, the witness could not be certain if the vehicle was directly next to, slightly above or slightly below, the gateway.
However, he was certain that it was a very short distance from, and directly in the path of the gate.
Asked, aside from what he reported above, he did not recall having seen the man before in that vicinity or any other place, nor caught the slightest glimpse of him since the crime that victimised the minor Madeleine.
The witness is not sure if he would recognise him again in the event that they should meet.

Finally, having been asked, he states that he intends to return to England next Saturday, 12 May 2007.

Email from Stephen Robinson, Northumbria police to Leicestershire police

Please find attached a witness statement provided by Richard McCluskey. Firstly may I apologise for the delay in forwarding but the system crashed at this end and the problem has taken some time to resolve.

Mr. McCluskey states he has already provided a witness statement in relation the enquiry having been on holiday in Portugal at the relevant time. He provided a statement in relation to suspicious activity he observed in the early hours of Saturday 5 May 2007.In the original statement Mr. McClusky states he described a male alighting a white coloured van and walking along a road carrying what appeared to be a motionless child. He then states he observed a distressed female run down a road and approach the same white coloured van.

Mr McCluskey did go into detail regarding the incident but then stated that all details were covered in his first statement, provided in May 2007. Not having had sight of the original statement it is obviously difficult to comment on the context and accuracy of the account given.

Having viewed recent media coverage regarding the investigation, M, McClusky now states that the female he saw and described is Mrs. McCann( the missing child’s mother). He states he is "almost certain" that they are the same person and has agonised for days over what to do and whether to contact Police. He is acutely aware of the possibly implications of his account. When asked why there had been such a time lapse in him making this "identification" he explained it as follows:
Mr. McCluskey states the thought had never crossed his mind that a child's parents could be implicated in such a matter. Media coverage over the past week or so has cased him to take a renewed interest in the case. The only thing which prevents Mr. McCluskey from stating he in 100% certain in his "identification" is the fact that he would , in his words, " hate to incriminate and innocent person."

Mr McCluskey appears to be a credible person and is not recorded on local intelligence systems.

Statement made 12th September 2007

I am the above named person and I live at an address know to Police. In early May 2007 myself and my wife were on holiday in Portugal. I have already provided a witness statement in relation to the disappearance of Madeleine McCann. I would like to add the following;

The events of the past week or so, with the McCanns being very much in the news, have triggered my memory in relation to the incident.

In my original statement I described a distressed female who ran down a road towards a white van I had described.

Having viewed recent news footage of Mrs McCann I am now almost certain that she is the female I described as being in a distressed state. I say this because of her slight build, high cheekbones and her eyes and hairstyle.

I've agonised for days over whether or not to contact the police about this because it is a terrible thing to accuse somebody of. It had just not crossed my mind that the child’s parents could in some way be involved in her disappearance.

I have watched a good deal of news coverage about the McCanns over the past week or so. Another thing which has played on my mind is the coverage of Mr McCann walking off the aeroplane holding one of his young children. The way he was holding the child over his left shoulder reminded me of the man carrying the child from the white van in Portugal.

Although I could not describe the male I'd seen in Portugal because he had his back to me, it was the particular way Mr. McCann held the child that made me think. He held the child over his left shoulder with his left arm supporting the child’s weight.

I am the above named person living at an address known to the Police.

At approximately 10 to 2 in the morning of Saturday 5th May 2007, I was on holiday in the town of ALVOR, PORTUGAL, with my husband Richard. We were walking up the bank from the town returning to our hotel complex known as, CLUBE ALVORFERIAS, after a night out. We were the only people on the street. We were on the main road which was dark but lit by street lighting.

As we approached the hotel Raymond(sic) - (Richard surely ??) - drew my attention to a vehicle which had stopped on the junction across the road. It was parked in the middle of the junction and initially I had thought it had broken down because of the way it was stopped. I did not have any glasses on but I was able to distinguish a male with a child get up and stagger up the hill. I can say the vehicle was about 20-30f when it stopped (PAGE ONE) but we had a clear and unobstructed view of the junction. There was no traffic and the junction was well lit with street lighting. Raymond(sic) then decided to go across and check out the vehicle. We both went over and wrote the vehicle registration of the white 'pick-up' vehicle down on my hand. We had been at the vehicle only a very short time, possibly a couple of minutes when a woman and a couple in a dark vehicle appeared from the road in front of the van almost simultaneously. I could describe the woman as 5 ft 5 inches - 5ft 6 inches blonde ponytail with a very worried / white face. I only noticed she was casually dressed. I could see that the male who got out of the car was on his mobile phone. We got into conversation as he could speak English and I asked him whether he was looking for a man with a child to which he said yes. He said he had seen the man hit the girl who was her(sic) (possibly should be 'him') and had turned around to see if he could catch him which was how he had ended up here. I also asked him if he knew about the missing child to which he said yes. I said can we leave it with you and he said 'yes'. He was still on the (page 2) phone at this time.

We left and returned to the hotel. We went to security to report the matter but the doors were locked. We therefore went to our room and had a coffee watching Sky News. We saw the news that the girl still had not been found and a report of a couple acting suspiciously. We could not settle and returned to security and woke him up and explained the situation, after which we returned to the pick-up and saw it and the woman still there. At this point the security guard said leave it with me and initially we did. However after a while we had not had anybody call so we went back down and spoke to the security man who stated he had spoke to the woman who said she had a family argument over not being able to find a child minder, and he had to leave the van there for the boss to pick it up. We were incensed by this in light of what was on the news and Richard asked for the Police and contacted them himself.
