They have suffered a hurtful whispering campaign implying they or members of the group they dined with on the night their four-year-old daughter Madeleine disappeared had been involved in her murder or abduction.

The couple have endured the slurs with dignity, but now they appear to be ready to fight back.

And one particular target appears to have fallen into their sights - glamorous Portuguese TV reporter Sandra Felgueiras.

For the Portuguese people, the blonde broadcaster has become the face of the Madeleine story, bringing live updates to their living rooms on national television station RTP.

But the McCanns are incensed over at least one live broadcast by Miss Felgueiras, 30, in which she is said to have implied Mrs McCann could have murdered her own daughter.

Now the McCanns are considering taking libel action under Portuguese human rights laws protecting the right to a 'good name', said a friend.

In the week leading up to the 100-day anniversary of Madeleine's disappearance, there was a flurry of media reports based on the police theory that the little girl died the night she vanished.

Some implied that the McCanns or their friends, with whom they were dining at the Mark Warner resort in Praia da Luz, were somehow involved in her disappearance.

A source close to the McCanns said: "This is about trying to stop lurid accusations being aired. She [Felgueiras] was outrageous that week in the run-up to the 100 days. She really was outrageous."

The source claimed Miss Felgueiras's report 'encouraged a media frenzy', adding: 'Both the McCanns are hard-working, law abiding professionals. It is very important to protect their reputation.'

The exact wording of Miss Felgueiras's live report is unknown, because nobody has specified which one of many is at issue.

Miss Felgueiras said last night she had no idea which report it might be and denied ever branding either of the McCanns a 'murderer'.

She said: "I never said that and I never insinuated anything like that. I never in my life put anyone under suspicion but just told viewers that police are investigating the possibility that Madeleine has died and that it is murder or an accident.

"I'm absolutely sure that everything I said was only what the police were telling us concerning this new lead of the investigation.

"If the McCanns presume that this is an accusation against them, then that is their assumption, not mine. My conscience is completely clear."

Miss Felgueiras, who has personally interviewed the McCanns on several occasions, added: "I am the most moderate reporter. Sometimes other channels talk about things that I refuse to talk about. I even made a live report saying everybody is innocent until they go to court.

"Also I never talk about Kate and Gerry in an isolated way, I always talk about the couple. So it's very strange to be accused of saying Kate did something."

The McCanns and their friends have been battling adverse publicity for the past three weeks following a series of leaks from Portuguese police to the local media.

Fuelled by an absence of clues as to what really happened to Madeleine, Portuguese newspapers have made allegations as offensive as they are unlikely.

The McCanns have been accused of doping their children to get them to sleep, leaving them alone for hours on end while getting drunk, and of mounting a cover-up.

Their holiday friends have been accused of giving conflicting accounts of the evening, and one, Dr Russell O'Brien, was forced to defend himself against the hurtful and untrue suggestion that he was 'missing' at the time Madeleine vanished.

Mr McCann is set to talk for the first time about how becoming "household names' has taken its toll on his family.

He will travel to the Edinburgh International Television Festival this weekend where he has been invited to speak about the "double-edged sword" of launching such a wide public appeal to try to get his daughter back.

The campaign has so far failed to achieve a breakthrough, and the spotlight has turned on the parents, who have been upset by the "aggressive and intrusive" Portuguese paparrazi, said a source close to the McCanns.

The article that is the subject of the McCann's legal action

Tal & Qual (pronounced [taliˈkwaɫ]; loose translation: Just Like That) was a weekly Portuguese tabloid newspaper, established in July 1980, that was published on Fridays. The newspaper was part of the Controlinveste group. Its last edition came out on 28 September 2007. The paper closed because of a drop in circulation, down from over 21,000 in 2004 to 13,000 by the end of 2006.[1]

On 31 August 2007, the parents of Madeleine McCann announced that they were suing the newspaper for libel after the newspaper reported that the "police believe" Kate and Gerry McCann killed Madeleine, suggesting she may have died in an accident or from a drugs overdose. The police stressed that the McCanns were not suspects (at the time: they later became so), but Tal & Qual stood by the story.[2] The journalist who wrote the article, Catarina Vaz Guerreiro, said "I can't reveal my source, but I have complete trust in them. I strongly believe that the person that gave us this information is telling the truth."[3]

The parents of Madeleine McCann are considering taking legal action over a tide of slurs in the Portuguese media.

    Kate and Gerry McCann are said to be considering suing one of Portugal’s most famous TV reporters, Sandra Felgueiras, in a further sign of the couple’s growing frustration over some of the coverage of their daughter’s disappearance.

     
     

    The couple are understood to be upset by remarks made by the 30-year-old presenter, who works for station RTP, about Kate McCann in one live broadcast.

    The development comes as Mr McCann prepares to talk for the first time about how becoming “household names��?has taken its toll on his family since the ordeal of losing his daughter.

    Speaking at the Edinburgh International Television Festival tomorrow, he is expected to discuss how launching such a wide public appeal to find the four-year-old has been a “double-edged sword��?

    Kate and Gerry McCann are so angry about claims they drugged and killed their daughter they are prepared to step into the witness box to fight clear their names, it emerged yesterday.

    The couple are suing Portuguese newspaper Tal & Qual for alleged defamation after it published a front page story claiming detectives believe the couple was responsible for Madeleine's death.

    They say the article implied that the Policia Judiciaria (PJ) in the Algarve think the four-year-old died from an accidental overdose of drugs, possibly sedatives. The couple, from Rothley in Leicestershire, have grown increasingly angry about the speculation surrounding their daughter's disappearance. They have told friends they will fight the criminal case all the way to the courts. If successful, they can then apply for indemnity in the civil court.

    If the McCanns do give evidence at trial, it will be the first time they have publicly discussed the case as they are not allowed to talk about the investigation.

    But under Portuguese law, they can talk about events that night as part of other legal proceedings. "They are 100pc o­n this," said a friend.

    "They will take it all the way if necessary and take to the witness stand to defend their reputations."

    Yesterday, Mr McCann said the couple ��?who are both doctors - were determined to challenge the "ludicrous" reports.

    "Tal & Qual claimed we killed our lovely daughter Madeleine," he alleged.

    "This is without evidence or truth. "The past 120 days have been horrific for us, our family and friends. We have tried to ignore some of the more ludicrous speculation but we simply could not ignore this report."

    The cardiologist insisted he and his wife, both 39, were not suing for money and their lawyer Carlos Pinto de Abreu from Lisbon is working o­n a pro bono basis.

    "Our daughter Madeleine was snatched from her bed o­n May 3," said Mr McCann. "She is still missing. The police have said time and time again we are not suspects.

    "These are the facts. Everything else is at best speculation and in some cases downright lies."

    Mr Pinto de Abreu said the couple had suffered enough without being the centre of press speculation.

    "It is people's dignity which is being questioned, and it is their image which is being dragged through the dirt. What has been happening is not legitimate and, above all, is inhumane."

    The legal action was prompted after Tal & Qual, a weekly newspaper with a circulation of 27,000, published a front page report o­n August 24 with the headline "PJ believes that the parents killed Maddie".

    McCanns sue Portuguese newspaper

    GERRY AND Kate McCann are planning to sue a Portuguese publication, Tal & Qual, for defamation.

    At the centre of the action is a front page report in the newspaper on August 24, entitled “PJ believes that the parents killed Maddie��? where the words “killed Maddie��?were highlighted. According to a press release on behalf of the McCanns, the story continued on page seven, with the headline “PJ believes in the fault of the parents��?

    The report allegedly implies that Madeleine died from an excess of drugs, which may have been sedatives.

    In an official statement, the McCanns said: “This statement is without truth or evidence��? They strongly deny that they have ever given their children sedatives and they believe the allegations are “very serious and highly damaging to their professional and personal reputations��?  

    Gerry McCann said: “Kate and I have been deeply hurt by the report in Tal & Qual. We firmly believe the report was speculative, defamatory and published despite official statements to the contrary��?

    A court in Porto will deal with the case against the publication’s director, Emídio Fernando, and journalist Catarina Vaz. Gerry McCann said: “We hope that this action will encourage responsible reporting in the future.��?BR>
    Meanwhile, the Bishop Ellis Catholic Primary School in Thurmaston, Leicestershire, where Madeleine was due to start from yesterday has left a desk open for her in the classroom. Children and teachers said a prayer for her and lit a candle.

    KATE and Gerry McCann last night threatened to sue over allegations that they had drugged their children on the night Madeleine went missing.

    The furious couple went on the offensive after reports in the Portuguese press claimed DNA tests would prove they had sedated all three of their children. 


    The McCanns, who are both doctors, have consistently denied ever giving Madeleine or the twins Sean and Amelie any drugs whatsoever and called the repeated slurs “outrageous��?and “hurtful��?

    The couple’s official spokesman Clarence Mitchell said: “Contrary to renewed speculation in the Portuguese press, Gerry and Kate McCann wish to make it categorically clear that they have never, ever used sedatives on their children. 

    “To suggest otherwise is as outrageous as it is hurtful.��?Mr Mitchell said the couple would be closely monitoring the reports in both Portugal and the UK and would take legal action if necessary. 
    The angry response followed yet more unsubstantiated slurs in the Portuguese press claiming the results of long awaited DNA and toxicology tests would prove the couple had drugged their children. 

    The report appeared in the 24 Hours newspaper, which has followed the McCann case closely, but has been the source of some of the more outlandish reporting. 

    It has been widely reported in Portugal, but never officially confirmed, that detectives working on the five-month investigation believe the McCanns killed their daughter with an accidental overdose of sedatives and then staged her abduction to cover their tracks. 

    It is understood the basis for this wild theory was simply  the fact that on the night Madeleine went missing the two-year-old twins, Sean and Amelie did not wake up during all the confusion.

    Little is known about the forensic tests currently being undertaken at a laboratory in Birmingham, but 24 Hours claimed on its front page that the results were now complete. 

    Without naming its source the report stated the tests indicated the presence of drugs in DNA samples belonging to Madeleine and the twins. 

    The Forensic Science Service refused to comment on the reports. Spokeswoman Laura Mackin said: “We don’t comment on any tests from the lab. 

    The inquiry is ongoing and we just can’t comment. We are just working closely with the police.��?The McCanns have insisted they have never administered anything stronger than the widely used children’s painkiller Calpol, Gerry’s mother Eileen recently admitted it was possible the children had been drugged by an intruder. 

    Last week Eileen McCann, 69, said: “I really believe they (whoever took her) gave her a drug. There is no way they carried her out of there without her awakening. “If she was taken when she was sleeping by somebody she did not know, she would have screamed the place down.��?/SPAN>

    One of the McCanns��?neighbours at the Ocean Club, Pamela Fenn, who has been interviewed by the police, has stated that she heard a little girl crying in the apartment the night before Madeleine went missing, exploding the idea that the children were being sedated every night.

    Portuguese police are hoping detailed tests will be able to ascertain whether the strands of hair came from Madeleine’s head when she was alive or after she died and also whether they show any traces of sedatives or drugs which could explain how she died.

    But friends of the McCanns have always maintained that any of Madeleine’s DNA which is found in the vehicle has a “wholly innocent��?explanation. 

    They have explained that the hire car was used to transport items of Madeleine’s unwashed clothes in the weeks after she went missing as well as rubbish which contained dirty nappies belonging to the little girl’s brother and sister. 

    The couple are now planning to hire their own forensics experts to refute the claims put forward by the Portuguese police.     The thriller Gone Baby Gone is directed by the actor and tells the story of a missing four-year-old girl. The star agreed to put off opening the film - which had been due to be screened at the London Film Festival next week - without any intervention from the family. 

    Speaking at the US premiere in Los Angeles, the star said he understood why the distributors, owned by Disney, decided to pull the film. 

    He said: “It just came down to the fact that there is a family there, and there is a country that has been exposed to the story and seems to have become to a certain degree emotionally sensitive to it. “Disney thought they would err on the side of good taste and postpone it until it calmed down a bit.��?/SPAN>

    Yesterday Gerry and Kate McCann’s spokesman Clarence Mitchell said that it had been a welcome decision. 

    He said: “We thank him for being thoughtful enough and sensitive enough to Gerry and Kate’s position to make such a commercial decision. 

    “Obviously we hope Madeleine will be found very soon to enable Kate and Gerry to move on, but also to enable him and the movie to go ahead in due course.��?nbsp;

    The film is based on the book by bestselling novelist Dennis Lehane and bears some bizarre coincidences with the McCanns��?own circumstances.

    It is about the search for a girl called Amanda who police believe was kidnapped from her bed after her parents left her home alone. 

    The girl is played by a young actress called Madeline (COR) O’Brien, who bears a close resemblance to little Madeleine, who was taken six days before her fourth birthday.

    THE Liverpool-born mother of Madeleine McCann is considering legal action against claims she sedated her daughter on the night she disappeared.

    In their first direct statement to the media in weeks, Kate and husband Gerry said they wanted to make it “categorically clear��?they have never used sedatives on any of their children.

    The former Notre Dame school pupil said comments to the contrary were so hurtful she felt compelled to speak out.

    The couple’s lawyers were last night studying speculation in the Portu-guese press that tests on evidence carried out in the UK suggest that their elder daughter and twins Sean and Amelie were given the drugs on May 3 ��?the date of Madeleine’s disappearance.

    The McCanns��?state-ment read: “Contrary to renewed speculation in the Portuguese press, Gerry and Kate McCann wish to make it categorically clear they have never, ever used sedat- ives on their children.

    It came as it emerged tourists who stayed at the resort where Madeleine went missing have been asked to provide DNA samples and fingerprints.

    The move is said to have come after detec-tives uncovered evidence of a possible kidnapper.

    It has been reported the head of the British invest-igation wrote to holiday-makers asking for their help in solving the case.

    Madeleine disappeared days before her fourth birthday in Praia da Luz, in the Algarve.

    Leicestershire Constab-ulary, co-ordinating the investigation in Britain on behalf of the Portu-guese authorities, would not confirm whether Superintendent Stuart Prior had sent the appeal. Nor would it confirm whether police in Britain were interviewing former guests at the Ocean Club, in Praia da Luz.

    The letter reportedly states Portuguese detec-tives have failed to identi-fy samples recovered from the resort.

    On Tuesday, one of Portugal’s most senior detectives took charge of the investigation and ordered a further search of the McCanns��?holiday apartment.

     24-8-2007 - The McCann's Are Seriously Going to SUE?
     
    Ohman, let me come up for air. I was sunk by that news. Slander. Yep, they're going after a top TV news presenter, Sandra Felgueiras, for allegedly implying Kate could have killed Madeline. Feigueiras denies it. Not only is that ridiculous, they've only heard about the newscast and are demanding transcripts. I'm looking at them as greedy, not grieving, parents.

    Wait until they hear what was said on a show on Sic. I was just slipping into a needed nap and my telemobile, cellphone, whatever people call them, began beeping. I'm sleeping, I'm sleeping. The need for some zzzz's was over-powering. I woke a couple of hours later and struggled to read and understand the 'breaking news' text messages. I knew they had to do with the McCanns and something about an ex-cop and the Brits withholding the DNA from the Portuguese.

    I could feel the excitement just from the words in CAPS and that it consisted of 3 linked messages. Her English, though many times better than my Portuguese, is sometimes difficult to decipher. We'd been talking about the McCanns the afternoon before, so she was all jazzed getting this news to me. I saw her later and we stood on a corner and I began to drill her about the messages and what exactly did she mean. Ah, it was a an ex-PJ (Judiciary Police) who went OFF on the McCanns and Brits on a segment of "Fatima Lopes" and and that he was a presenter on “Casos de Polícia��?". Yikes. I knew of neither. I also heard, long before her, that the kids were sedated at night. The twins didn't wake even when the room was full of hysterical people and that makes me wonder if there's any truth to it. Gut says yes.

    Remember, this is far from being accurate or proven, it's just what I was told and things I've thought. She went on that the ex-PJ, Mavio Flores, called the McCanns criminals, not victims and went on and on about the blood results being in both the rooms in the flat and the car and belonging to Madeleine and how the Brits wouldn't release them to the Ports. I wish I knew what was really said and most of all, why he said it. Has he snapped? I wouldn't blame him. This blasted case has made people taut and tense, it's really beginning to piss people off. Not Madeleine, they still hope and pray for her, but the parents are a different story.

    I've never witnessed anything as chin-dropping, eyes-widening, groan-inducing as this case. I have never really seen either McCann actually grieve. I'm remembering my friend told me it was all about money and had been from the beginning and that the speed in which the fund was set up is suspicious. She also went on about government connections in the UK, going as far as Gordon Brown and that they're being given special treatment. Are they actually *looking* for Madeleine or using her to rake in the bucks and become rock stars. That was one thing mentioned during our discussion. Disgusted, I'm so disgusted at them, at this whole mess and my heart aches for Madeleine and the loss of her innocence, dead or alive.

    So, they're going to sue. Good luck! People don't sue here for the reason that the red tape is all but impossible to untangle and if the case makes it to court, it could take eons to be heard, let alone settled. Slander? Why aren't they suing every newspaper that has ever printed anything about them they don't like. Why don't they sue me? I'm talking shit about them. They can go through a legal procedure to sue this chick in the time they should be spending, even if pretending, to look for their little girl? Unbelievable.

    I have to stress I'm passing on things I heard. And they're as valid as any story going around about this. It's so shielded, so convoluted, wrapped in layers and shrouds of secrecy, getting to the real truth is proving to be harder than finding the Holy Grail or mopping up Jack or Jill's spilled water. It's said still waters run deep. Fathoming that, I begin to seriously wonder if this case has an end. That would be the biggest tragedy of all, the not knowing of what happened to Madeleine. She'd join the ranks of Jon Benét Ramsey.

    I thought I was finished, but not after reading what I just did. I needed to be sure of the reporter's name and wound up on the Brit rag, Daily Mail. Wow. The headline, good lord, "113 day of lies and smears against the McCanns". It begins with the bit about the TV report and then other "lurid" things being said and they mentioned the guy my friend was going on about. Also, anyone who reads this regularly is aware I did a thing about the massive number of searches I have every day for "mccanns swingers". Check this out.:

    According to a retired detective speaking on Portuguese television, Kate and Gerry McCann were 'swingers' who enjoyed wifeswopping with the friends they were on holiday with.

    There was not the slightest evidence to support the claim, but the idea was picked up by Portuguese newspapers.
    She didn't tell me that and I've never read it in Port news. That's the Brits for ya. I wonder if there's more anywhere. I haven't checked Portuguese news yet. Nope, came up empty, just as I believed I would.

    Time to bail. I had to get this out of my head or it would start leaking and the wandering words would have me herding them all day. That's all she rote. (Nope, not a typo). Thanks to "Belly" for the music, wrapping this with "Every Word".

    Anybody else fed up with the whole thing? Can somebody remind the Mccanns it's about their daughter, and not about them

    McCanns sue Portuguese newspaper

    GERRY AND Kate McCann are planning to sue a Portuguese publication, Tal & Qual, for defamation.

    At the centre of the action is a front page report in the newspaper on August 24, entitled “PJ believes that the parents killed Maddie��? where the words “killed Maddie��?were highlighted. According to a press release on behalf of the McCanns, the story continued on page seven, with the headline “PJ believes in the fault of the parents��?

    The report allegedly implies that Madeleine died from an excess of drugs, which may have been sedatives.

    In an official statement, the McCanns said: “This statement is without truth or evidence��? They strongly deny that they have ever given their children sedatives and they believe the allegations are “very serious and highly damaging to their professional and personal reputations��?  

    Gerry McCann said: “Kate and I have been deeply hurt by the report in Tal & Qual. We firmly believe the report was speculative, defamatory and published despite official statements to the contrary��?

    A court in Porto will deal with the case against the publication’s director, Emídio Fernando, and journalist Catarina Vaz. Gerry McCann said: “We hope that this action will encourage responsible reporting in the future.��?BR>
    Meanwhile, the Bishop Ellis Catholic Primary School in Thurmaston, Leicestershire, where Madeleine was due to start from yesterday has left a desk open for her in the classroom. Children and teachers said a prayer for her and lit a candle.

    KATE and Gerry McCann could sue Portuguese cops for £1million for failing to find missing daughter Maddie.

    Top Portuguese lawyers are said to believe that if or when the case is wound down and “archived��?the McCanns could sue the state.

    Carlos Pinto de Abreu, one of the McCanns��?Portuguese lawyers, said it would be “technically possible��?to sue the Portuguese police for their failure to find Madeleine, who vanished from the family’s holiday flat in Praia da Luz on May 3.

    A source close to the McCanns said last night: “Suing is something they will consider but they can’t concentrate on anything but finding Maddie.

    “This is not about the money.��?

    The McCanns, of Rothley, Leics, have already put into action plans for libel cases against Portuguese newspapers.

    Family spokesman Clarence Mitchell said yesterday: “It is a matter for their lawyers.��?

    One of the Portuguese lawyers acting for the McCanns, Rogerio Alves, told the newspaper Diario de Noticias: "What has to be done will be done in due time."

    A second member of their legal team, Carlos Pinto de Abreu said such a move was "technically possible" but would be difficult in practice.

    It would rely on the McCanns being able to prove that Portuguese police had failed to act on information which could have led them to Madeleine.

    One of the witnesses who claims to have seen the four-year-old in Morocco has told how police refused to investigate her sighting, saying: "It can't have been Madeleine because we believe she's dead."

    Other witnesses have complained that Portuguese police never returned their calls or investigated their sightings.

    Mr Pinto de Abreu said: "You would have to prove that it was intentional. It is very, very difficult, almost impossible to do.

    "Only if you had information that someone had said they knew where the child was and the police had taken no action.

    "It wouldn't be easy but it would be possible."

    Asked if it was something he would consider on behalf of the McCanns, he said: "I cannot think about it."

    The lawyer said it would not be possible for the couple to sue the Portuguese state for defamation over the decision to make them suspects in their daughter's disappearance.

    He said: "The officials have always said that all lines of the investigation remain open.

    "That is quite a cautious opinion. That's all they've said."

    The couple's spokesman Clarence Mitchell said: "It is something for their lawyers to consider further on down the line.

    "The only way this case will close for Kate and Gerry is when Madeleine is found safe and well."

    There has been speculation that the case could be closed as early as Christmas

    Kate and Gerry McCann were ”horrified and devastated��?/EM> by the Portuguese press claiming Portuguese police believe Gerry is not her father. The latest report claimed Madeleine’s DNA was different to that of her twin siblings, because she has a different father.

    As 24 Horas informed British police had visited a sperm bank the couple used and tracked down the four-year-old’s natural father to rule him out of any involvement in her abduction.

    But family spokesman Clarence Mitchell said that the McCanns planned to sue 24 Horas ”and any other media outlets that print these claims as soon as the official suspect status is lifted.��?/EM>

    ”It is indeed absolutely untrue. It is offensive to suggest that Gerry is not her natural father,��?/EM> he added.

    Luis Fontes, 24 Horas co-editor, said he stood by the story, which he claimed was confirmed by both Portuguese and British pathology sources as well as Leicestershire and Portuguese police.

    A spokesman for the Forensic Science Service in Birmingham, where scientists are still testing samples sent to them from Portugal, insisted the story had not come from them.

    A spokesman for Leicestershire Police said that they had refused to comment when contacted by 24 Horas on Wednesday.

    Nor would Policia Judiciaria comment further:

    Dear Members,

    We are calling for your support in targeting You Tube to have vile material removed from their website. We don't just want to send one or two complaints, we want to send a bulk within a 24 hour period. Our target for the 24 hour complaints period is Tuesday 26th February. On that day, with everything in place, we would like as many posters as possible to flag the material and send an email of complaint.

    We were directed to the You Tube site a few days ago, regarding a really vile piece of video footage. We were astonished that You Tube allowed this to remain on their site and be viewed. In our opinion that sends the wrong message to millions of viewers. The video was of Madeleine talking from beyond the grave, asking Kate why she had killed her. Then we noticed other footage, just as vile, accusing Kate of killing Madeleine. It appears that in allowing this material to be viewed, You Tube supports it. People are openly accusing Kate and Gerry of killing Madeleine without any concrete evidence. What is more disturbing is that by their actions these people are promoting hate behaviour towards the McCanns. You Tube's inability to effectively judge material before allowing publication on their website, is allowing people to spread hate and lies about the case. Whatever happened to human decency and the principle of 'innocent till proven guilty in a court of law'? You Tube should review their publications criteria regarding this type of material because, currently, it's a free for all.

    Here is what we are hoping to achieve with your help.
    *Find as much unacceptable video footage on You Tube as possible and compile a list. At the bottom of this email are some of the links to footage we have found so far.
    *Encourage as many people as possible to register at You Tube for the sole purpose of flagging this material and then e-mailing them a complaint.
    *As already stated, we are hoping to make our voices heard over a 24 hour period, so as to target youtube with many hundreds/thousands of complaints. The date is set for Tuesday 26 February 2008.

    Madeleine Parents Set To Sue Newspapers

    Lawyers for Kate and Gerry McCann are considering taking legal action against British newspapers whose coverage they feel to have been incorrect and unfair.

    Principally they are looking at the publications in The Express Group: The Daily Express, The Sunday Express, The Daily Star and The Daily Star Sunday.

    Clarence Mitchell, the spokesman for the McCann family, confirmed that their lawyers were in discussions, but denied that any writs had yet been issued.

    "It's wrong to say that we're actually suing, but our lawyers have been assessing all articles, in all papers.

    "We are extremely unhappy with The Express Group's coverage. We always said it was the worst amongst all the tabloids."

    He also added that the figures that have been quoted in the media are wildly speculative and that The Express Group had made no initial offer for an out-of-court settlement.

    Under UK law, the McCanns and their lawyers have a year from the publication of an article to decide whether they wish to take legal action against its content.

    It is thought that in the case of the coverage they are assessing, that year would be up some time in mid-May, and a decision must be taken by then.

    Clarence Mitchell denied the family were taking this action because the Find Madeleine fund was running low.

    He said: "Yes, it's true that the fund is roughly half-way spent, but the main thing we require is an apology."

    He added that any money won as a result of legal action would go straight back into the fund.
