PC: "Did you get any sleep that night?”

DW: "Err well eventually err the twins were brought up into our apartment err and that again to me was err a very odd thing because they were fast asleep, they did not wake up.”

PC: "Were they brought up, so had they been taken out of their cots and brought up?”

DW: "Yeah, yeah. They were being carried, I think Fiona and Dave carried them up.”

PC: "And they were still not awake?”

DW: "Still not awake, and the cots were, because they were travel cots they brought up, you know and err put in the living room and they were put into the cots and they just carried on sleeping.”

PC: "In your experience, obviously you’ve had children yourself and you’ve got plenty of grandchildren, and am I to understand that Sean and Amelie stayed in your apartment for longer than that night?”

DW: "Err I can’t remember if they, no I think they just, just the one night, or two nights.”

PC: "But with all your experience of small children, you thought that was odd that they had not woken?”

DW: "Oh yeah definitely. Well even err the noise that was going on in the apartment and they slept through it all.”

PC: "Mm.”

DW: "They were taken from their cots when they were brought up to our apartment and they would have to come out into the cold and I would have err I would have expected some sort of awakening.”

PC: "Yeah. So after the twins had been brought up did Fiona and Dave stay in the apartment with you?”

DW: "Yeah well at that point Kate and Gerry came up as well and err because the Police had decided to close off the apartment, bit late in the day but you know, they came up and what we did we got the, there was mattresses on the spare beds in the room where L*** was sleeping so we got them and put them on the floor in the lounge beside the twins so that they could rest, if not sleep, err but by this time it must have been about half past four, five o’ clock in the morning.”
PC: "And how were they by that time?”

DW: "Err exhausted and obviously they didn’t sleep, I mean they were out again at the crack of dawn.”

PC: "Had anybody else gone from the apartment to do any searching, from your apartment?”

DW: "What, that night? Or…”

PC: "Mm.”

DW: "Well apart from the initial when, when the men were all err out searching I mean Dave was obviously one of them. I know there was a lot of err a lot of conversation going on about the fact that the Police, the Portuguese Police had not arrived err because I think the, err I don’t know if it was Russell and Dave that went down, only I think to reception and err I think they were also trying to get photographs of Madeleine printed and err I’m not sure if it was because of the, the delay in the Police arriving that they, I’m not sure who informed err Sky News of the event, you know a lot of that err I know Kate and Gerry spent a lot of time on the phone ringing people, they were just so, so beside themselves really.”

PC: "Once they arrived at your apartment did they stay there a while or do you remember them leaving?”

DW: "What, that night?”

PC: "Mm.”

DW: "Err I think, I think, I think they stayed there because it was very late or you know early, early morning and Kate wanted a priest, they couldn’t find a priest which, well I won’t, I won’t say what her language was but I’m, you know, Portugal’s a Catholic country and err no priest.”

PC: "Mm. So the events in your mind of that night are you don’t have a concept of time checking because you were just sitting and waiting and wondering and feeling helpless.”

DW: "Yeah, and I do know it was, it was very, you know, it was something like half past four or five o’ clock in the morning before we got to bed.”
 
 
 
So just before we move on to asking the questions from the Portuguese, there are two things that I wanted to go back over with you, one thing was about the twins and how deeply they’d slept that night.”

DW: "Mm.”

PC: "And you said you wondered if they’d perhaps been drugged.”

DW: "Mm.”

PC: "I think it’s one of the questions that the MCCANN’S want us to ask anyway, but have you ever seen their children being given any medication?”

DW: "Oh no, no.”

PC: "So how would you imagine that they may have been drugged?”

DW: "Err by the abductor. I think Madeleine would have been drugged as well.”

PC: "Yeah, and the night when they were sleeping, did anybody try to wake them? Other than it being noisy and they were moved.”

DW: "No, no I mean err when they, when they were brought up to our apartment err they had a sort of blanket over them and they were asleep on err I think it was David and Fiona that carried them up and they were just sleeping on their shoulder and obviously didn’t want to wake them up because the cots were being brought up and they were put, put, but you know my, my feeling is that they, I think a child normally would haven woken up under the circumstances.”

PC: "How were they when they woke up the following morning?”

DW: "Oh fine, yeah.”

PC: "No different to normal?”

DW: "Yeah, lively twins.”

Reply "And err eventually when err Dave and Fiona came back and I can’t remember if they came back carrying the twins or whether they came back first and said the twins are coming up here I can’t remember, err but the twins appeared err in our apartment, they were put down to sleep. That was when the Police had cordoned off the apartment and err Kate and Gerry came up.”

Reply "And then a lot of the time was spent with them, frantic really, on the phone to, to family you know absolutely distraught.”
4078 "Apart from David and Fiona and Gerry and Kate and the twins and your girls, who else did you see during that time? Sort of ten thirty in the evening to ten o’ clock the following morning.”
Reply "Well I think there was err some of the staff from the Ocean Club, the err I seem to remember err one or two of them being in the apartment initially, I think that was when they were err putting up the cots and stuff like that. Err I know when I got up in the morning err which I think might have been about seven o’ clock I don’t know, I’m not sure, Kate and Gerry had already left the apartment, they were out looking again as far as I know. Err we obviously had the twins for that day, we didn’t have them two nights, I just checked that.”

FIONA PAYNE
 
It was after four o’clock, erm, tut, again, I don’t know, that, that whole period, it’s hard to sort of put a time to it. I remember it being after four o’clock, probably about half past four when we went to bed. But in that ensuing time the PJ had arrived, erm, the plain clothes detectives, I think there was a couple of them and they’d been in the apartment and obviously they, at that point, had said they needed to close off the apartment or move the twins. Erm, so I’d suggested putting the twins up in our apartment, erm, Emma, who was there, had arranged some of the MARK WARNER Nannies to get some extra cots and more bedding, erm, and we set up the cots in our living room and a bed for Kate and Gerry as well, not that they used it, but, erm, and then I think, I think they were Policemen, I can’t remember who carried up Sean and Amelie. Erm, and we sat on the sofa, me and Kate with the twins asleep on us for a while, erm, and they didn’t wake up and, again, that was quite strange, even in the transfer and, and being handled by people that weren’t their parents, they didn’t, they didn’t wake up. Erm, and we settled them down and made a bed up for Kate and Gerry and I think it was around sort of half four’ish we decided we should all try and just get, get a rest, because everyone else had gone, you know, it was just, again, it was that feeling of helplessness really, everyone had gone, erm, you know, what are we supposed to do”.

“Erm, tut, so Dave and I went to bed and we tried to sleep. Erm, I think about half an hour after that or an hour after that it was starting to get sort of vaguely light and Kate had come into the room just said ‘Look, will you’, would I look after Sean and Amelie and said they need to go and look for Madeleine and, erm, which I did. And I was conscious that, you know, Kate and Gerry were wrapped up warm and went out on the streets looking for Madeleine

I stayed in the apartment, erm I was aware later that the GNR were there as I say they were wandering round the front and the back and, and the time when I came out and met Robert MURAT, erm I’m assuming that was sort of after sort of midnight, there and that sort of time because the uniformed Police were there, erm the sort of troops in their boots, I don’t, think they’re GNR, erm and then you know, I, I was just in, in the apartment for, for the most part just with Kate, erm I eventually moved up back to my apartment when it was suggested by the PJ that you know, they had to get the twins out, so I went to that part to organise our flats and you know, the, the nannies in with the travel cots and the bedding, I helped them set that all up, so at that point I was separate to Kate and Gerry. Erm and then I was just in, in our apartment, I’d say for, I’d say half three, four o’clock when they brought the twins up, erm I sat on the sofa with Kate next to me and say we had the twins asleep on us, a good half an hour with Kate, just in complete shock, sobbing. Erm, then we put the twins to bed in the, in the cots, I say we made Kate and Gerry a mattress up on the floor and we chatted some more and by about half four, we’d all decided to just try and lay down, at least just to, to get a rest if not sleep. Erm, Dave and I went into our room with Scarlet and sort of left Kate and Gerry in the living room with the twins really. I think Dave and I must have actually eventually dozed off for a bit, cos we got woken up by Kate knocking on the door and just you know, as I said earlier, suggesting they, they couldn’t sleep, they couldn’t, they couldn’t rest and they were just, it was driving them up the wall, just sitting there and not doing anything and they wanted to go out and look and would we just keep an eye on the twins”.

“Can you remember what sort of time that was roughly?”

“Erm it was still very cold and, and dark, erm I think it was you know, between five and six, I say, I say, I think we’d, we’d, we’d just dozed off, so erm it was still very early
. Er the next morning to be honest is a bit of a blur, I think with the kids we, we, our role really was just to try and keep some normality for the twins who were obviously er wondering what on earth was going on, erm then giving the kids breakfast and getting them dressed and sorted, getting to kids club and we just decided they should all do, you know have the day that they would normally have, so that was my role the following morning really, erm I’m trying to remember what, what I, well you’re not asking after ten o’clock are you, but certainly that was my morning, just getting them ready and erm dropping them off at the crèche”.

On the night of 3rd May, after having finished work, I planned to meet a group of colleagues at 22.30 to go out. At about 22.17 I received a call from Lyndsey Johnson, the Crèche Manager, informing me that the girl had gone missing. I met Lyndsey and the Service Manager, Amy Tierney, near to the Tapas Bar and we initiated the “Mark Warner procedures for the search of a missing child”.

This procedure involved the distribution of leaflets that had already been prepared, with the names of the locations, for the members of staff, indicating the zones that they should search. Once the location indicated had been searched, the leaflet was returned and another one with a different location was handed over. This procedure was followed by the members of staff, but on that night about 6 residents from the complex were also involved in the search.


I was told who the missing girl was and at the beginning of the procedure went to the McCann’s apartment to obtain the girl’s description and of the clothes she was wearing when she disappeared. When I arrived at the apartment, there was a lady on the terrace, whom I now know to be Kate McCann, accompanied by the wife of one of her friends, David Payne. Kate could not say a word, looked very upset and about to cry. It was Mrs Payne who provided me with the details that I needed.
I returned to the location where the leaflets were being distributed and passed on the information that I had gathered about the missing girl. Lyndsey was busy with the distribution of the leaflets and I went to search in the beach area. On my return I passed by the Duke Pub where I met other members of staff who also joined in the searches.

The hotel manager, John Hill arrived at the location from which the searches were being organised and I can confirm that he called the police. John stayed at the location and I several times went to search the grounds. I went with Amy and we searched the highest part of the complex behind the apartments. The search lasted for about 10 minutes and then we returned. At that moment John asked me to go to the apartment the girl had disappeared from and, on behalf of Mark Warner, provide all the help the family might need.

I went to the McCann’s apartment, entered by the patio doors and introduced myself to Kate and Mrs Payne. I entered the apartment living room and Kate and Mrs Payne stayed in the main bedroom, from where I could hear them both crying.

The twins were still asleep in the children’s bedroom and the door was half open.

A short while later, Gerry returned to the apartment accompanied by Russell. They also entered by the patio doors.

I don not remember the exact sequence of events at this time, but I do remember that I phoned John, who informed me that the police were on their way.

I remember that the police arrived between 00.00 and 00.30, entered by the main door and went to the kitchen with Gerry.

I went to the bedroom where Kate and Mrs Payne were. Kate was still upset, crying and calling Madeleine’s name, shouting “where is she?”
She also banged on the headboard. At that moment I went to check on the twins in their room and they were ok.

I remember being in the main bedroom with Kate, Mrs Payne, Gerry, Russell and David who were sitting on the bed and I sat on the floor. At that moment David suggested that the press should be contacted. Russell disagreed, saying they should keep calm and let the police take care of the situation.

At that moment Kate appeared to lose control, crying and constantly asking “where is she?” whilst banging on the bed.

Gerry remained calm throughout. On one occasion Kate and Gerry both went to the main bedroom and I could hear both of them crying.

Quite a bit later that night I remember the police asking everyone to leave the apartment. I received a call from John informing me that he had arranged for another apartment for the McCanns. I went to reception and helped Lyndsey to move the two cots to the new apartment

The McCanns went to the new apartment and I remember seeing Kate and Mrs Payne seated on the sofa, each holding one of the twins. I left the new apartment at 04.30 in the morning
after instructions from John Hill. I was the last to leave, the police had already left, but I left my number saying that I was available for anything that might be needed.

After a short rest I returned to work at 08.00. I did not see Kate or Gerry during the whole morning, but went to the new apartment at about lunchtime. Kate and Gerry were not there but there were other members of the group taking care of the twins.

I remember there were helicopters flying overhead and showing them to the twins.

I remember that both Kate and Gerry were calmer that day and Kate had stopped crying. They were accompanied by family members who had travelled to Portugal and by the local priest. I remember that on the night Madeleine disappeared, Kate wanted to contact the local priest, but it was not possible to reach him by phone.

I remember being present in the apartment with Kate, Gerry and other members of the family when they gave their first press conference. Gerry sat at the table and wrote what he wanted to say to the press and Kate, although she did not want to speak to the press, accompanied Gerry and stood by his side while he read the statement. I and the others stayed at the apartment door to observe.
