According to the document, Madeleine’s father received 14 messages on the 2nd may, the day before his daughter’s disappearance, coming from a telephone number that is officially unidentified. The same mobile phone sent 4 other messages to Gerry after the disappearance.

Gerry and Kate McCann have so far refused to provide detectives with the contents of the messages, but this did not stop the police finding out this information. It is the use of the contents of this information ��?in particular during a trial ��?that is being challenged by the criminal review judge.

Although the judge’s decision prevents the use of information prior to the disappearance of Madeleine, it has not prevented the detectives from finding out about the calls, and the inspectors know who was speaking to whom.

Rebelo’s men, were also able to go ahead with telephone intercepts taken after Madeleine’s disappearance whilst the couple and their friends were still in Portugal. Once they had returned to the UK, the PJ were expecting the UK authorities to continue this work, but it is not yet clear whether the information has been given back to them.

Pedro Frias did not refuse permission to gain access to all of the intercepts or recordings made during the enquiry, but he did not allow the detectives the right to use the contents of the txt messages sent and received by the McCanns before the 3rd May 2007.
