This thread is meant to list statements etc. that we know exist, because they are referred to in the files, but they are not available on the DVD released to journalists by the Portimão courthouse (source of our files here).

What I can think of, so far:

The 'sex offenders' annexes (we know from the McCanns documentary the McCanns have those in their possession).
Previous, contradictory statements made by David and Fiona Payne, as referred to by DC Marshall
Previous statements by Neil Berry, as referred to in his rogatory interview
salomon ES

I've just been following with great interest the other thread on dental records.
If I'm correct there's an analysis performed by the FSS on Madeleine's dental records that is referenced in the files but that has not been published.

There are also missing bits from the telephone records. I'm sure Santacoloma will be able to give more information about that, but there are no logical or reasonable explanations to justify why the phone records for some individuals go 2 days back before Madeleine's disappearance and for others they don't. And I think that there are also some day's (mid-week) missing from some of the Tapas.

Kazlux, just to clarify the difference between the official files and the DVD:

1 - It may be that some documentation that is mentioned in the official investigation files is not included in the DVD (either for lapse, technical reasons or others) but may actually be available to the public (in person) at the court of Portimao (or Faro - can't remember which).

2 - There is other documentation that is mentioned in the official investigation file, that is not included in the DVD and will not be available to public consultation at the court of Portimao (or Faro - can't remember which). This would information that is sensitive to the privacy of individuals (for example the list of paedophiles etc.).

Hopefully, if we are able to establish 1 ie the documentation that is mentioned in the files, BUT that is NOT included in the DVD, someone could try in Portugal to consult the investigation file in person at the court and check if any of these documents that exist but that are not on the DVD actually exist (and are available) in the Court where the file is archived.

Russell O'Brien's 8th April Rogatory Interview?
I've read that although there is no DVD recording because the equipment broke down (?!) there's a transcript of the interview. I may be looking in the wrong place (or maybe should have gone to Specsavers :s_wink ) but I can't locate it anywhere.

I've found references to it - timings of interview and that he ratified and signed copies of it but I can't find any content.

that comes from is signed statement on the 10th of April
regarding what happened on the 8th

Quote:
On the 8th April 2008 officers from Leicestershire Constabulary interviewed me in order to clarify certain points and in order for me to provide further information where possible. The interviews were visually recorded, however I understand that due to technical difficulties the equipment failed to record. I have been informed that these questions arise from an official request from the Portuguese authorities. I am aware that my statement will be subject to the Portuguese Criminal Code in addition to English Law. I have been informed that this statement has been made from the monitoring notes which were taken at the time of the interviews being conducted.

There's no statement missing from Russell O'Brien but none of the rogatory inquests made in April 2008 appear on the DVD

Surely a PJ statement (I understand he's a permanent resident in PT?) must have been taken from John Geraghty? He was middleman in handing over the keys of the church to the McCanns and he also retained the McCanns' hire car in his garage, after they returned to England. (Ostensibly for team McCann to have their own forensic tests conducted).

He was too involved in the aftermath (at the very least) to be ignored by the police and I don't believe he was.

astro

The written questionnaires that were answered by, at least, David and Fiona Payne, as mentioned in the message that accompanies the Gaspars' statements.

missing the intercalary FSS reports, referenced on the DVD.

I've just come across this (2nd half) of the rogatory letter in Skeptikals thread and it definitely says that:

- Since there was an Alert given by the two dogs (dead body scent/blood), behind the sofa of the living room, it was possible to consider that MADELEINE McCANN's dead body may have been in that place, which originated the gathering of material to be subject to biological examination.

Page 74

- - According to a preliminary, not final report made by the Forensic Science Service (FSS) of Birmingham, England, there is cellular material in the collected samples; however, the FSS do not definitely state that this cellular material belongs to MADELEINE.

Where's the prelim report?
